Why Make a Will?

This section highlights why having a legally valid Will is so important.

lt is a sad fact that, on average, 12,000 people die in this country every week, and as many as 9,000 will do so without leaving a legally valid Last Will and Testament.

Those who die "intestate" – that is without leaving a legally valid Will – usually assume that the passing of their possessions to their husband or wife or other members of the family will happen automatically.

This is not the case, and many families have had to face financial difficulties and lengthy legal proceedings - simply because no Will had been written, or because a Will was not properly prepared.

If someone dies "intestate", then under the Law of Intestacy the State will write a Will on their behalf, and their possessions are then distributed accordingly. Most people, likely including you, would prefer to decide for themselves how their estate should be divided, rather than leave that decision to the State.

All this happens at a time of great distress for the bereaved family, and adds further, and unnecessary, extra difficulties at such a time.

A properly prepared Last Will and Testament gives you the opportunity of passing on particular gifts to your friends or favourite charities and, if you have a young family, of appointing guardians to look after them. It is your legal right to do this, and one of life's important responsibilities..

The Next Step

This section describes what you can do NOW to arrange a Will, and why you should do so.

Are you worried because you haven’t written a Will? Are you concerned that your Will is out-of-date? Are you uncertain whether your Will is legally valid? If so, it’s now quite simple and straight forward to put your mind at rest.

Many of us find it difficult or inconvenient to arrange to visit a solicitor – it often takes at least two appointments and usually during the working week.

So, why not take advantage of our personal service? We can take your instructions by email, Royal Mail, or by telephone. In every case you will be assigned to one of our consultants who will be available to explain all the points that you need to consider – together you can discuss the details of how your wishes can best be included in your Will.

The reason that we can maintain our prices at such an affordable level is that we do not employ a salesforce, so you will not receive unwanted visitors. However, if you do live in an area served by one of our consultants, we can normally arrange to visit you in the privacy of your own home and at a time to suit you, but only if you so request.

After we receive your instructions we will process them using leading modern computer software, designed especially for this purpose. This drafts your Will, using traditional phrases and clauses to ensure that your heirs inherit your property exactly according to your wishes.

We specialise in writing Wills, and in providing associated services, and can thus offer you a most efficient service that can cater for a whole range of situations and family circumstances.

If you’ve read this far it has probably always been your intention to write your Will. However, like most others you found it easier to put it off. So how about NOW? There’s no time like the present. Surely you and your family deserve the feeling of security that comes only from leaving your affairs in good order? And top of the list in this is leaving behind you a legally valid Will.

Perhaps you have made a Will previously, but it does not now cover your circumstances and current wishes. Simple additional requests can be added to your Will by writing a Codicil.

However, if your circumstances have changed significantly, perhaps due to your recently having been married, or divorced, or started sharing property with a new partner, then it’s essential that you write a new Will.

Like everyone else, your circumstances will change from time-to-time, and because of this we recommend that your Will be reviewed at least every five years, and immediately if there is any major change in your situation.

We can assist you in all of these situations. A visit to the Why Elias Wills? page will explain why we feel you should consider using our services in particular. Or, if you still have some general questions, perhaps our Commonly Asked Questions page will answer them.
